These terms and conditions (“Terms”) are a contract between you and BusinessNZ (“we”, “us”, “our”) for use of the BusinessNZ website and related services (together, the “Service”).

If you do not agree to these Terms, you must not use the Service. We may update these Terms from time to time. The “Last updated” date at the top of this page shows when they were last revised. Continued use after changes take effect means you accept the updated Terms.

BusinessNZ is an online business directory for Aotearoa New Zealand. We help people discover local businesses by category, region, and suburb. Listings may include information sourced from the official New Zealand Business Number (NZBN) register and from business owners who claim or manage their profiles.

We provide the Service on an “as is” basis. While we work to keep information accurate and up to date, we do not guarantee that every listing is complete, current, or error-free.

You must be at least 16 years old to use the Service. By using BusinessNZ, you confirm that you meet this requirement and that any information you provide is accurate.

If you use the Service on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

You may use BusinessNZ to search for businesses, view listings, and contact businesses through the channels they provide. You agree not to:

• use the Service for any unlawful purpose or in breach of any applicable law;
• scrape, harvest, or systematically copy listing data without our prior written consent;
• interfere with or disrupt the Service, including by introducing malware or attempting unauthorised access;
• misrepresent your identity or affiliation when contacting businesses or submitting enquiries;
• post false, misleading, defamatory, or abusive content.

Businesses may claim and manage listings on BusinessNZ. When you claim a listing, you represent that you are authorised to act on behalf of that business and that the information you submit is accurate to the best of your knowledge.

We reserve the right to verify claims, request supporting documentation, edit listings for clarity or consistency, suspend listings that appear fraudulent or misleading, and remove listings that breach these Terms or applicable law.

Where a listing displays an NZBN or verification badge, that signal reflects data from or checks against the official NZBN register at the time of verification. NZBN verification does not constitute an endorsement, guarantee of quality, or warranty of any business's products or services.

You should conduct your own due diligence before engaging any business. BusinessNZ is not a party to transactions between users and listed businesses.

The Service may allow reviews, quote requests, messages, photos, or other content (“User Content”). You retain ownership of your User Content, but grant us a non-exclusive, royalty-free licence to use, display, and distribute it in connection with operating and promoting the Service.

You are responsible for your User Content. We may remove content that we reasonably believe is unlawful, misleading, offensive, or otherwise breaches these Terms. Quote requests submitted through BusinessNZ are forwarded to relevant businesses; we do not guarantee responses, pricing, or availability.

Verified and Featured listing plans are subscription services billed as described on our pricing page. Fees are quoted in New Zealand dollars unless stated otherwise. By subscribing, you authorise us to charge your chosen payment method on a recurring basis until you cancel.

Unless required by the Consumer Guarantees Act 1993 or other applicable law, subscription fees are non-refundable for partial billing periods. You may cancel at any time; cancellation takes effect at the end of the current paid period. We may change pricing with reasonable notice to existing subscribers.

The BusinessNZ name, logo, site design, and original content are owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, or distribute our branding or site content without permission, except for personal, non-commercial use of publicly available listing information.

Business names, logos, and other materials on individual listings belong to the respective businesses. NZBN is administered by the New Zealand Companies Office; we are not affiliated with or endorsed by that agency.

Listings may link to external websites or contact methods operated by third parties. We are not responsible for the content, privacy practices, or conduct of those third parties. Your use of external sites is at your own risk and subject to their terms.

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge that we will handle personal information in accordance with that policy and applicable New Zealand privacy law, including the Privacy Act 2020.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or free from errors.

Nothing in these Terms limits rights you may have under the Consumer Guarantees Act 1993 where you acquire services as a consumer and those guarantees apply.

To the fullest extent permitted by law, BusinessNZ and its directors, employees, and contractors will not be liable for any indirect, incidental, special, or consequential loss arising from your use of the Service, including loss of profits, data, or business opportunity.

Where liability cannot be excluded, our total liability to you for any claim arising from or related to the Service is limited to the greater of (a) NZD $100 or (b) the amount you paid us in the 12 months before the claim arose.

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your User Content, or your misuse of the Service.

We may suspend or terminate your access to the Service at any time if we reasonably believe you have breached these Terms or if continued access would harm the Service or other users. You may stop using the Service at any time. Sections that by their nature should survive termination will continue to apply.

These Terms are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the New Zealand courts. If you are a consumer, you may also have rights under mandatory local consumer protection laws.
